If you do not agree with these terms, please do not use our website or place an order.
These Terms of Service should be read together with our Returns, Refunds & Exchanges Policy, Shipping Policy and Privacy Policy.

2. Using Our Website
You may use our website for lawful purposes only.
You agree not to:
- Use the website for fraudulent or unlawful purposes.
- Attempt to gain unauthorised access to our website, systems or accounts.
- Interfere with the operation or security of the website.
- Copy, reproduce or commercially exploit our website or content without permission.
- Use automated systems to scrape or collect website content without our permission.
- Submit information that is knowingly false, misleading or fraudulent.
- Use another person's payment details or account without authorisation.
We reserve the right to restrict or terminate access to the website where we reasonably believe that it is being misused.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, colours, dimensions and other information displayed on our website are accurate.
However, colours displayed on your device may differ slightly from the actual product due to screen settings, lighting and other technical factors.
Product photographs are intended to provide a representation of the product. Minor variations in colour, finish or appearance do not necessarily constitute a defect where the product otherwise conforms to its description.
We will not intentionally provide misleading or inaccurate product information.
4. Prices
All product prices are displayed on the website before you complete your purchase.
The applicable currency will be displayed according to the store, customer location or checkout settings.
Prices may change from time to time, but a price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.
Where applicable, taxes, VAT, duties, delivery charges or other additional costs will be displayed or explained before you complete your purchase.
For international orders, additional customs duties, import taxes or other charges may apply depending on the destination country.
Where such charges are the responsibility of the customer, they will not normally be included in the product price unless expressly stated otherwise.
5. Pricing Errors
We make reasonable efforts to ensure that all prices displayed on our website are correct.
If a product is displayed at an obviously incorrect price due to a technical or human error, we reserve the right to cancel the affected order.
If payment has already been taken, we will provide an appropriate refund.
We will not use a pricing error provision to avoid fulfilling an order merely because we later decide that a product was priced too cheaply.
6. Placing an Order
When you place an order through our website, you are making an offer to purchase the selected products.
Before completing your order, you will have an opportunity to review the products, quantities, delivery information and applicable charges.
You are responsible for ensuring that the information you provide is accurate and complete.
After placing an order, you will receive an order confirmation.
An order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted or dispatched.
We may contact you if further information is required to process your order.
7. Acceptance of Orders
We reserve the right to decline or cancel an order in reasonable circumstances, including where:
- A product is unavailable.
- There is an obvious pricing or product information error.
- We reasonably suspect fraudulent or unauthorised activity.
- Payment cannot be successfully processed.
- We are unable to deliver to the selected destination.
- An order appears to have been placed for unlawful purposes.
- A technical error has affected the order.
Where we cancel an order after payment has been received, we will arrange an appropriate refund.
Nothing in this section affects any mandatory consumer rights applicable to your purchase.
8. Payment
Payment must be completed using one of the payment methods made available at checkout.
You confirm that you are authorised to use the payment method provided.
We do not store full payment card details unless expressly stated otherwise.
Payment processing may be handled by third-party payment providers. Their own terms and privacy policies may also apply.
We reserve the right to use reasonable payment verification and fraud-prevention procedures.
9. Delivery
We aim to dispatch and deliver orders within the delivery timeframes stated on the website or at checkout.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
Delivery may be affected by circumstances outside our reasonable control, including courier delays, customs processing, extreme weather, strikes, public emergencies or other unforeseen events.
Where applicable consumer law provides a specific delivery timeframe or remedy for delayed delivery, those statutory rights will apply.
Please see our Shipping Policy for current delivery destinations, costs and estimated delivery times.
10. International Orders
Cultured Eyewear may sell and ship products internationally.
Depending on the destination, an international order may be subject to:
- Import duties;
- Customs charges;
- VAT or other taxes;
- Clearance fees; or
- Other charges imposed by the destination country.
Unless expressly stated otherwise at checkout, such charges may be the responsibility of the customer.
Customers are responsible for providing accurate delivery and customs information.
Cultured Eyewear cannot guarantee that a particular country will permit the importation of a particular product.
11. Returns & Exchanges
Our Returns & Exchanges Policy forms part of these Terms of Service.
Cultured Eyewear offers a voluntary 14-day exchange period for eligible change-of-mind returns. Under this voluntary policy, we offer exchanges only, for a different colour or model. We do not offer refunds for voluntary change-of-mind returns.
Additional statutory consumer rights may apply depending on where you live. These may include statutory cancellation, withdrawal, repair, replacement, refund or other consumer rights.
Where applicable law provides a consumer with rights that differ from or exceed our voluntary exchange policy, the applicable law will take precedence.
Please see our Returns & Exchanges Policy for full details.
12. Product Defects & Consumer Guarantees
Cultured Eyewear is responsible for providing products that meet the applicable legal requirements.
If a product is defective, faulty, unsafe, incorrectly described or otherwise fails to conform to applicable legal requirements, you may have statutory rights to a remedy.
Depending on the country of purchase and the circumstances, the remedy may include repair, replacement, price reduction or refund.
Nothing in these Terms of Service limits any mandatory statutory guarantee or consumer protection that applies to your purchase.
13. South African Consumer Rights
For customers purchasing in South Africa, applicable rights under South African consumer protection legislation apply, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
South African law provides specific requirements for electronic transactions, including information that must be made available to consumers and certain rights relating to online purchases.
Where applicable, those statutory rights take precedence over any conflicting provision of these Terms.
14. United Kingdom Consumer Rights
For customers purchasing in the United Kingdom, applicable UK consumer protection legislation applies.
This includes statutory rights relating to:
- Online and distance purchases;
- Cancellation;
- Faulty goods;
- Goods not matching their description;
- Goods not being of satisfactory quality; and
- Goods not being fit for purpose.
Nothing in these Terms is intended to exclude or restrict those rights.
15. European Union / EEA Consumer Rights
For customers purchasing in the European Union or European Economic Area, applicable consumer protection legislation applies.
This includes, where applicable:
- The statutory right of withdrawal for eligible online purchases;
- Statutory rights relating to defective or non-conforming goods;
- Applicable legal guarantees; and
- Other mandatory consumer protections.
Nothing in these Terms is intended to exclude or restrict those rights.

If you submit content to Cultured Eyewear, including photographs, reviews, comments or other material, you confirm that:
- You have the right to provide the content;
- The content does not infringe another person's rights;
- The content is not unlawful, fraudulent or misleading; and
- The content does not contain malicious software or harmful material.
Where you submit content for publication, you grant Cultured Eyewear a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that content for legitimate marketing and business purposes.
We reserve the right to remove content that is unlawful, offensive, misleading or otherwise inappropriate.
We will not use submitted content in a manner that falsely suggests an endorsement or affiliation where none exists.
18. Reviews
Customers may be invited to submit reviews of products they have purchased.
Reviews should represent the genuine experience of the person submitting them.
We may moderate or remove reviews that contain:
- Spam;
- Offensive or abusive material;
- Personal information;
- False or misleading claims;
- Illegal content;
- Advertising unrelated to Cultured Eyewear; or
- Content that does not relate to the product or customer experience.
We will not knowingly create or publish fake customer reviews.
19. Website Availability
We aim to keep our website available and operating correctly.
However, we do not guarantee that the website will always be available, uninterrupted or free from errors.
The website may occasionally be unavailable because of:
- Maintenance;
- Technical problems;
- Security issues;
- Updates;
- Third-party service interruptions; or
- Circumstances outside our reasonable control.
20. Third-Party Services
Our website may use third-party services including payment providers, courier companies, analytics services, marketing platforms, social media services and other technology providers.
These services may have their own terms and privacy policies.
Cultured Eyewear is not responsible for the independent operation of third-party websites or services, except where responsibility cannot legally be excluded.
21. Links to Other Websites
Our website may contain links to third-party websites.
These links are provided for convenience and do not necessarily mean that Cultured Eyewear endorses or controls those websites.
We are not responsible for the content, security or privacy practices of third-party websites.
22. Limitation of Liability
Nothing in these Terms of Service excludes or limits liability where such exclusion or limitation would be unlawful.
This includes liability that cannot legally be excluded or limited in relation to matters such as:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Defective or unsafe products where applicable law prevents exclusion;
- Statutory consumer rights; or
- Any other liability that cannot legally be excluded.
Subject to the above, Cultured Eyewear will not be responsible for indirect or consequential losses to the extent that such limitation is permitted by applicable law.
This section does not affect your statutory consumer rights.
23. Events Outside Our Reasonable Control
Cultured Eyewear will not be responsible for failure or delay caused by circumstances outside our reasonable control.
Examples may include:
- Natural disasters;
- Severe weather;
- War;
- Civil unrest;
- Government restrictions;
- Strikes;
- Epidemics or pandemics;
- Major transport disruption;
- Customs delays;
- Internet or telecommunications failures; or
- Third-party service failures.
Where such an event occurs, we will make reasonable efforts to minimise its impact and resume normal operations as soon as reasonably possible.
24. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
By using our website, you acknowledge that your personal information may be processed in accordance with that policy and applicable privacy laws.
For South African customers, this includes applicable obligations under the Protection of Personal Information Act 4 of 2013 (POPIA).
For customers in other jurisdictions, additional privacy laws may apply, including applicable UK and EU data protection legislation.
25. Marketing Communications
Where permitted by applicable law, we may send marketing communications if you have provided appropriate consent or where another lawful basis applies.
You can unsubscribe from marketing communications at any time by using the unsubscribe option contained in our marketing emails or by contacting us.
Transactional communications relating to your orders may still be sent where necessary.
26. Changes to These Terms
We may update these Terms of Service from time to time.
The latest version will be published on this page together with the date it was last updated.
Changes will not retrospectively alter the terms applicable to an order that we have already accepted, except where required by law.
27. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful where possible.
The remaining provisions will continue to apply.
This section does not permit Cultured Eyewear to enforce a provision that applicable consumer law prohibits.
28. Governing Law & Consumer Rights
These Terms are intended to operate across multiple markets.
The law applicable to a particular purchase may depend on the customer's location, the contracting entity, and applicable mandatory consumer protection legislation.
Nothing in these Terms prevents a consumer from relying on mandatory consumer protections available in their country of residence.
Where a mandatory consumer law gives a customer rights that cannot be excluded by contract, those rights will continue to apply.
29. Complaints
If you have a complaint about an order, product or service, please contact us first.
We will make reasonable efforts to investigate and resolve legitimate complaints fairly and promptly.
Please provide your order number and a description of the issue so that we can assist you efficiently.
